Legal Services

Credit Needs can help you fight collections agencies, and in fact, collect up to $500 in damages. Are collections calls causing you deep anxiety? Are collectors calling you multiple times a day? Are they disclosing your financial distress to family or friends? Are they rude, threatening, or aggressive?

The majority of Credit Needs clients report that they have experienced harassment from
debt collectors violating these rules. This rule-breaking is rampant, because most
consumers do not know their rights under the FDCPA and do not feel they have the
power to fight back. Our pre-paid legal plan can help.

If you answer yes to any of the questions above, you are not alone. Further, under the Federal Fair Debt Collections Practices Act (FDCPA) 20 these collections agents are violating your rights, and you have the right to recourse. Basic provisions of the law ban collections agencies from:

  • calling you before 8 a.m. or after 9 p.m.;
  • calling you at your place of employment once you ask them not to do so;
  • communicating about your debt with third parties, such as your employer,
    neighbors and family;
  • using abusive, rude, or threatening language; and
  • harassing you with excessive phone calls.

Further, the FBCPA requires collections agencies to do the following things:

  • communicate through your attorney if you’re represented by one;
  • cease contact entirely if you request it;
  • demonstrate proof that the consumer actually owes the debt which the collector is attempting to collect.

The Process of Legal Services is Simple:

Fill out the application.

After reviewing your completed application, a Credit Needs agent will contact you to clarify the necessary information.

You will join the online Education and Enforcement Portal where Credit Needs will explain your rights under the FDCPA. The portal will also help to:
a. teach you how to identify a violation of the FDCPA;
b. record the violating phone calls and voice mail messages through our Creditor Monitoring System; and
c. help you fill out the official violation report forms.

You will then be referred to our network of attorneys who specialize in representing clients under the FDCPA. These attorneys will seek to end the harassment, and win a cash settlement of up to $500 per violation.

In addition to representing you against your creditors who are violating the FDCPA, many of Credit Needs clients wish to have the added reassurance of legal representation while working through their financial difficulties. This piece of mind cannot be overstated. Should you wish to work with our network of attorneys, do not hesitate to contact us.
